Car Finance Law - Family Dispute -HELP!?
Can anyone please advise of rights relating to car finance. Basically my partner had car finance in his step mothers name with the payments coming out of his Dads bank, but paid by my partner himself to his Dad. All payments were made on time and in full however due to a family dispute his Dad cancelled the Direct Debit for the final payment. His Dad and step mum have now separated and she is trying to make things difficult. My partner has agreed to make the payment directly to her next month but she is threatening to take him to court being the lovely woman she is! (NOT) The car is in my partners name and is HPI clear according to the checks we have made, but as the finance is in her name or was at least what rights does she have? I personally want to tell her to take a running jump after what she has put ourfamily through but want to know my stuff in terms of the law and who has the upper hand legally before i open my mouth. Any help would be much appreciated.
What is she taking you to court for? She has no rights the car is in his name. Why dosn't he approach the finance company and pay the final payment. Sounds a bit muddled to me. UK
If the finance is in her name she would be cutting her own nose of to spite her face if she stops paying it. It would be her credit file that is damaged. If the car is in your partner's name and he has possession of it then there is very little she can do. You could ring the finance company and explain and make the final payment. If it has been paid off there is nothing for her to take your partner to court for.
There is just one payment left? Get him to pay it directly to the finance company, explaining there is a problem with the debit card, and here is HER final payment. The loan is in her name, and the finance company will accept the money as her repayment - they aren't going to ask whose money it is. As for the car, it is registered in your partner's name so legally it is his. She has no claim whatsoever.
